The National Police Chief spoke about online gambling on social media where there was an issue of the "303 Consortium" or online gambling protection led by Inspector General Ferdy Sambo. The issue mentions Sambo and other high-ranking police officials who are suspected of being the backers of the gambling business.
Meanwhile, Sambo is a former Head of the Professional and Security Division (Kadiv Propam) of the National Police who is now a suspect in the alleged premeditated murder of his subordinate, Brigadier Joshua Hutabarat.
The busyness of the case attracted the attention of a UM Surabaya legal expert, Satria Unggul Wicaksana, to provide a response.
According to his explanation, normatively, Indonesia has Law Number 7 of 1974 concerning controlling gambling, accompanied by Government Regulation (PP) No 9 of 1981 concerning implementing gambling control. Included in this context is related to the widespread development of online gambling, where in Article 27 paragraph (2) of the ITE Law in conjunction with Article 45 paragraph (2) of Law 19/2016 which explains that: Everyone who intentionally and without rights distributes and/or transmits and/or makes accessible Electronic Information or Documents that have gambling content, can be punished with imprisonment for a maximum of six years and/or a fine of up to IDR 1 billion.
"This means that crimes against gambling, both conventional and online gambling, are included in criminal offenses that can be disciplined by law enforcement," said Satria Monday (22/8/22).
Satria added that the momentum to clean up the "303 consortium" must be supported by strong legal politics, both from the National Police Chief, the Attorney General's Office, to the Minister of Politics, Law & Security (Menkopolhukam) to eradicate it, down to its roots, with the principles of impartiality and equality before the law.
"Including, involving PPATK, BPK, and BPKP to identify the flow of funds from the management of this illegal business that approached various important people and law enforcement officials who would hinder the process of eradicating this organized crime," concluded the Director of the Center for Anti-Corruption and Democracy Studies (PUSAD) UM Surabaya.
